Effective July 8, 2026 · Buildsmart is a product of MattBeth Growth Circle / Axes Education Group ("we," "us"). By creating a profile, purchasing, or using Buildsmart, you agree to these terms.
Buildsmart is an educational construction-training simulator based on a real South Florida duplex project. It teaches sequence, inspections, documents, and field judgment for learning purposes only. It is not construction, engineering, architectural, legal, financial, or code-compliance advice, and no contractor-client, design-professional, or fiduciary relationship is created by using it. Building codes, fees, prices, and inspection practices vary by jurisdiction and change over time; the material reflects one real project and current market estimates, not your project.
Real construction involves significant physical, financial, and legal risk. You agree that any decision you make on a real project — hiring, payments, scheduling, inspections, means and methods, safety — is yours alone, made in consultation with your own licensed contractor, design professionals, and local building department. You assume all risk arising from applying anything you learn in Buildsmart to real-world work.
To the fullest extent permitted by law, you release, discharge, and agree to hold harmless MattBeth Construction LLC, Axes Education Group, MattBeth Growth Circle, and their owners, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to your use of Buildsmart or your application of its content to any real-world project, except where caused by our willful misconduct.
Buildsmart is provided "AS IS" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. We don't warrant that completing Buildsmart will produce any particular outcome — passing real inspections, obtaining licensure, employment, or profitable projects.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to Buildsmart shall not exceed the amount you paid us in the 12 months before the claim, and in no event will we be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or project losses.
You agree to indemnify and hold us harmless from claims by third parties arising out of your violation of these terms or your application of Buildsmart content to real-world work.
Paid tiers unlock additional simulator content and downloadable training materials, licensed to you personally — one purchase, one person; please don't share unlock codes or redistribute materials. Refunds per the 14-day guarantee above. After 14 days, sales are final. We may update, improve, or modify content over time; paid access includes future updates to your tier.
Game progress is stored in your browser (localStorage) on your device. When you create a profile, request a readiness score, or purchase, we collect your name and email to deliver those things and send occasional Buildsmart/MattBeth updates — unsubscribe anytime by replying. We use Google Analytics to understand anonymous usage (steps, timing) and improve the experience. Payments are processed by Stripe; we never see your card number. Forms are processed by Netlify; the site is served by Netlify and Cloudflare. We don't sell your data.
These terms are governed by the laws of the State of Florida, venue in Broward County. If any provision is unenforceable, the rest remain in effect. These terms plus your purchase receipt are the entire agreement. We may update these terms; continued use after changes is acceptance.
